Most people are aware of the fact that blockchain can underpin cryptocurrencies - but now we are beginning to see that it is a practical implementation for managing government programs and the creation of tokenizing financial instruments so with those developments in the Republic of the Marshall Islands we have also seen that compliance with regulations is an ongoing issue. <h2>Blockchain in Social and Government Programs</h2>Through its inherent features such as transparency, traceability, and efficiency, blockchain provides new ways to manage programs that require these characteristics. As a result, many governments and institutions have started taking advantage of tokenized assets to facilitate more streamlined financial management, create new opportunities for combating fraud and increase confidence in the government. For example, by using tokenized debt instruments, the government can now obtain real-time audit access to its debt instruments as well as automated procedures for settling the debt obligation. This allows governments to distribute money faster and more accurately in a manner that is easier for them to manage.Source: Conceptual design / stock image of blockchain network with government icons. <h2>The USDM1 Bond: A Case Study</h2>Recently, the Republic of the Marshall Islands has announced the introduction of a new bond called USDM1, which is fully backed by short-term U.S. Treasury securities on a 1-for-1 basis. The USDM1 bond allows for a digital representation of government debt to be issued on a blockchain technology platform — increasing both liquidity and transparency while creating value for the Republic through increased access to credit markets. Guidepost Solutions, LLC, a prominent monitoring and compliance consulting company, was engaged by the Marshall Islands government to establish a framework for evaluating the regulatory compliance and possible application of sanctions for the USDM1 bond issuance. According to Julie Myers Wood, Chief Executive Officer of Guidepost Solutions, “The blockchain is an effective and functional medium for the exchange of value, but it also requires continual oversight to ensure that regulatory compliance is maintained.” <img src="https://jid.rerrkvifj.com/media/customer/creatorSystem/e856094e-4fa5-456a-8f6e-8260ce24a2c0.jpeg">Source: Stock illustration of digital finance and tokenized assets. <h2>Compliance Challenges in Blockchain-Backed Programs</h2>Even though there is an opportunity for greater operational efficiency through blockchain, there still exists the same requirement for regulatory compliance for blockchain technologies that exist with any other form of financial transactions.&nbsp; <h2>Below are some examples of challenges related to regulatory compliance:</h2> To ensure compliance, tokenized instruments are expected to satisfy the following requirements: - Compliance with International Sanctions - Tokenized instruments are required to comply with international sanctions laws (for example; the OFAC list). - Compliance with AML &amp; KYC Requirements - Tokenized instruments must require the implementation of strict AML and KYC (Know Your Customer) requirements for all transactions. - Legal Establishment - The legal establishment of the first-ever tokenized instruments requires an appropriate legal framework to legally establish those instruments, e.g.; the issuance of tokenized government debt. - Auditability &amp; Monitoring - There must be a consistent and clear audit trail created for all transactions to demonstrate compliance while ensuring people's protection regarding sensitive information enjoys appropriate security. Tokenizing assets can produce higher levels of transparency, faster settlement times and improve efficiencies; however, creating a tokenized security requires an adequate level of compliance to protect the rights of investors. As more governments turn to blockchain for their social-good initiatives, debt management processes, and digital currency efforts, consulting firms like Guidepost Solutions will play an important role in ensuring that these projects fulfill their compliance obligations while maximizing their overall value.
